The U.S. Supreme Court ruled 6–3 that sweeping global tariffs imposed under the International Emergency Economic Powers Act (IEEPA) were unlawful. The Supreme Court found that the President exceeded statutory authority by enacting broad import duties without congressional approval.
Shortly after the ruling, the administration indicated it was evaluating alternative legal authorities to preserve certain tariff measures. The President later announced plans to move forward with a 10% universal tariff under Section 122 of the Trade Act of 1974, which he increased to 15% the next day. Details, including scope and effective date, are expected to be clarified through an executive order.
“The ruling invalidates tariffs imposed under the International Emergency Economic Powers Act (IEEPA) but does not automatically prohibit current or future tariffs enacted under other statutory authorities,” says Omar Elkhatib, director of government relations at The Vision Council.
Implications for the Optical Industry
According to Elkhatib, the Supreme Court’s ruling has the potential to significantly impact the optical industry and the broader vision care marketplace. The industry is heavily reliant on global supply chains for frames, lenses, components, and finished goods.
The ruling may open the door to repayment claims for previously collected duties. According to The Vision Council, the reimbursement process would likely require formal administrative procedures or litigation. The organization also notes that importers should monitor announcements from U.S. Customs and Border Protection for specific instructions on timing the timeline and treatment of in-transit or recently entered shipments.
Elkhatib emphasizes the public health dimension of trade policy. “Ensuring that patients maintain access to affordable, high-quality vision care products and services remains essential to public health,” he says. “As trade policy and economic conditions continue to evolve, The Vision Council will monitor developments closely and provide timely information and guidance to help industry stakeholders stay informed and make sound business decisions.”
